DMCA Policy: How to Send a Copyright Notice

The Digital Millennium Copyright Act (DMCA) is the US law for notices of online copyright infringement. If you are a copyright owner, or you act for one, you can email hamzaakram789@gmail.com with the subject line “DMCA Notice.” Under 17 U.S.C. § 512(c)(3), a notice should include these six items.

  1. Signature.

A physical or electronic signature of the copyright owner or an authorized agent.

  2. The work.

A description of the copyrighted work you say was infringed.

  3. The material.

The exact page links (URLs) where the material appears on our site.

  4. Your contact details.

Your name, email address and mailing address or phone number.

  5. Good-faith statement.

A statement that you believe in good faith that the use is not authorized by the owner, its agent or the law.

  6. Accuracy statement.

A statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the owner.

What Happens After You Send a Notice

We read each notice, check that it includes the six items, and look at the page you name. If the claim is valid, we remove or disable access to the material, or we change it, and we tell you what we did.

We may ignore a notice that is incomplete or not a real claim. Also, keep in mind that anyone who knowingly makes a false claim in a notice can be held liable under 17 U.S.C. § 512(f). Please check that your use is not a fair use before you send a notice.

Counter-Notices

If we remove material and you believe we made a mistake, you can send a counter-notice to the same email address. It should include your signature, the material and where it appeared, a statement under penalty of perjury that you believe in good faith that the removal was a mistake, and your name and contact details.

It must also say that you agree to the jurisdiction of the federal court for your address and that you will accept service from the person who sent the original notice. We then follow the process in 17 U.S.C. § 512(g).

Our Position on a DMCA Designated Agent

FiftyStatePay does not host content that users post. We publish only our own pages. A formal agent registration with the U.S. Copyright Office is meant for services that store user content, so we have not registered one. Please send notices to the email address above instead.

If we ever allow users to post content, we will register an agent and list the details here first.

If Someone Copies Our Content

Have you found our content on another site? Please tell us the link to our page and the link to the copy. We may then ask the site’s host or the search engine to remove it. We would also thank you for the tip.
